Extended Warranty Terms & Conditions
1. Scope of Extended Warranty
Barriers Direct are pleased to offer our customers an extended warranty on certain products.
Our extended warranty applies for manufacturing defects and mechanical failures only. In particular, during the period of any agreed extended warranty, we warrant that the relevant Product(s) shall:
- Conform in all material respects with their description and any applicable specification agreed with us in writing; and
- Be free from material defects in design, material and workmanship.
Please note that our extended warranty does not cover any other issues or failures, including (without limitation):
- Any aspects or elements relating to servicing of the Product(s), such as installation;
- Misuse of the Product(s), including any use which is not expressly in accordance with our or the manufacturer’s express guidance or instructions;
- Wear and tear; and
- Any accessories or spare parts for the Product(s), including where those accessories or spare parts are bought with or separately from the relevant Product(s).
2. Duration of Extended Warranty
Our extended warranty applies for the first year immediately following the expiry of the manufacturer’s standard warranty on the relevant Product(s) (the ‘Extended Warranty Period’). For the avoidance of doubt, our extended warranty lasts no longer than 1 year beyond the expiry of the manufacturer’s standard warranty on the relevant Product(s).
If you wish to purchase an extended warranty, you can either:
1. Purchase the extended warranty when you purchase the Product(s) from us. Any extended warranties you wish to purchase should be displayed in your “checkout basket” prior purchase – please ensure they are. If they are not displayed, please contact us.
OR
2. Contact us at
feedback@barriersdirect.co.uk to [request an estimate for an extended warranty], including details of the relevant Product(s). [Then follow the steps in our email response] to purchase the extended warranty.
Any estimates we provide for extended warranties are valid for [14 days], after which they shall expire and you will need to obtain a new estimate from us.
All extended warranties must be purchased at least [14 days] before the expiry of the manufacturer’s warranty for the relevant Product(s). Our extended warranties cannot be purchased [separately or] at a later date.
3. Relying on the Extended Warranty
If you need to rely on the extended warranty, please:
o details of the relevant Product(s), including its serial number;
o your information;
o proof of the extended warranty (such as your email conformation); and
o details of the manufacturing defect and/ormechanical failure.
Our team will respond to your email as soon as possible after receipt. Please note that our team may request additional information, pictures or proof from you – in order to rely on the extended warranty, you must comply with their requests.
If our team requests it, you must return the relevant Product(s) to us in accordance with the “Returns and Refunds” section of our Terms & Conditions.
Upon receipt of the relevant Product(s), we shall, at our sole option, repair or replace the defective Product(s), or refund the price of the defective Product(s) in full. If the Product has been discontinued since original purchase, we may (at our sole option) replace it with a “like for like” product, or a product which is similar to the version you have in situ.
The extended warranty shall apply for the remainder of the Extended Warranty Periodto any repaired or replaced Product(s) we provide under this Section 3, subject to the below.
The extended warranty shall not apply to any repaired or replaced Product(s) if:
- you make any further use of such Product(s) after giving us notice under this Section 3;
- the defect arises because you failed to follow any oral or written instructions as to the storage, commissioning, installation, use and maintenance of the Product(s) or (if there are none) good trade practice regarding the same;
- the defect arises as a result of us following any drawing, design or specification supplied by you;
- you alter or repair such Product(s) without our express written consent.
- the defect arises as a result of fair wear and tear, wilful damage, negligence, or abnormal storage or working conditions; and/or
- the Products differ from their description as a result of changes made to ensure they comply with applicable statutory or regulatory requirements.
4. Other Exclusions
All of our extended warranties are non-transferable. This means you cannot transfer them to another person/party, even if you sell the relevant Product(s) to them.
During the Extended Warranty Period, we will only provide the warranty in the UK. We are not responsible for paying any travel or delivery costs where the product is located outside the UK.
Any actions or services performed by us in rectifying damage or defect caused as a result of any excluded conditions may be subject to additional charges for labour, transportation and parts.
The extended warranty not available to you if the relevant Product(s) you present is: i. defaced; ii. Altered; iii. damaged beyond repair; iv. in need of a repair not included inthe extended warranty; and/or, v. does not match the product and serial number details as registered for the extended warranty.
To the maximum extent permitted by law, the extended warranty does not include repair of failures caused by: i. modification or attachments; ii. accidents or misuse (to include without limitation failure to follow instructions or guidance); iii. unsuitable physical or operating environment; iv. third party products; v. maintenance by anyone other than us; vi. products, components, parts or material not furnished by us.
NEITHER BARRIERS DIRECT NOR ITS THIRD PARTY SUPPLIERS OR RESELLERS MAKE ANY OTHER WARRANTY, GUARANTEE, OR CONDITION OF ANY KIND, WHETHER EXPRESS, IMPLIED, LEGAL OR STATUTORY, WITH RESPECT TO THE PRODUCT(S), AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, BARRIERS DIRECT SPECIFICALLY DISCLAIMS ANY IMPLIED, LEGAL OR STATUTORY WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR, GENERAL OR NORMAL PURPOSE, SATISFACTORY QUALITY, DURABILITY AND WARRANTIES AGAINST LATENT DEFECTS.
5. General
These extended warranty terms are governed by English law and come under the exclusive jurisdiction of the English courts.
By registering your extended warranty, you agree to be bound by these extended warranty terms.
